  • Legal document: The Khata Certificate is a legal document that establishes the property’s existence and ownership and is required for property registration and other legal transactions.

  • Transfer of property: The Khata Certificate is required for the transfer of the property from the seller to the buyer, and it is essential to have the Khata Certificate transferred in the new owner’s name.

  • Bank loans: Banks and financial institutions require the Khata Certificate as proof of ownership and to assess the property’s value while providing loans or mortgages.

Types of Khata Certificates

In Bangalore, there are two different types of Khata Certificates issued by the Bruhat Bengaluru Mahanagara Palike (BBMP), the local municipal corporation.

They are:

  • A Khata Certificate: This certificate is issued to property owners who have paid property taxes on their properties. It contains details such as the property owner’s name, property identification number, location, and dimensions. A Khata Certificate is necessary for all property-related transactions.

  • B Khata Certificate: This certificate is issued to properties that have not been assessed for property taxes or have not paid property taxes. Properties that are built without obtaining proper permits or do not adhere to the building bylaws are issued B Khata Certificates. These properties are considered illegal, and B Khata Certificate does not provide ownership rights to the property owner. B Khata properties are not eligible for any building loans or government schemes.

It is important to note that a B Khata Certificate is not equivalent to a Khata Certificate and does not provide “COMPLETE” legal validity or ownership rights. Properties with a B Khata Certificate are required to obtain an A Khata Certificate by paying property taxes and obtaining necessary permits and approvals from the concerned authorities.

Here are the step-by-step procedures for transferring Khata in Bangalore:

  1. Obtain the sale deed: The first step in transferring the Khata is to obtain the sale deed, which is the document that transfers ownership of the property. The sale deed should be registered with the Sub-Registrar’s Office.

  1. Obtain the latest property tax receipt: The seller should provide the latest property tax receipt, which indicates that all property taxes have been paid up to date.

  1. Obtain a No Objection Certificate (NOC): The seller must obtain a NOC from the BBMP, indicating that there are no outstanding dues or violations on the property.

  1. Obtain a Khata transfer application form: The buyer should obtain a Khata transfer application form from the BBMP website or from the local BBMP office.

  1. Fill out the application form: The buyer should fill out the application form with accurate details of the property, including the current owner’s name, the new owner’s name, the property address, and the property’s dimensions.

  1. Attach the required documents: The buyer should attach the following documents with the application form:

  • Sale deed

  • Latest property tax receipt

  • NOC from BBMP

  • Identity proof of the buyer

  • Address proof of the buyer

  • PAN card of the buyer

  1. Submit the application: The buyer should submit the application form along with the required documents to the local BBMP office.

  1. Pay the transfer fee: The buyer should pay the Khata transfer fee, which is based on the property’s value and is typically around 2% of the property’s value.

  1. Obtain the acknowledgement slip: The BBMP will issue an acknowledgement slip indicating that the application has been received.

  1. Track the application status: The buyer should track the application status online or by visiting the local BBMP office.

  1. Collect the Khata certificate: Once the Khata transfer application is approved, the buyer can collect the Khata certificate from the BBMP office.
